BOOKING AND CONFIRMATION

The signing of the booking form constitutes acceptance of the following conditions by the client. No contract shall exist until we have received a signed booking form together with the appropriate payment, and have confirmed the reservation in writing.

The person signing the booking form does so on behalf of every person named on the form. The signatory must be a member of the party occupying the property and must be over 25 years of age.

The property cannot be shared, assigned or sublet and only the persons shown on the booking form are permitted to stay in the property. No single-sex groups are permitted without owner's prior consent.  No pets are allowed in the villa. Smoking is not permitted in the villa although it is permitted on the deck area by the pool.

INITIAL PAYMENT

A non-refundable deposit of £100 / $180 per week is payable at time of booking. For bookings made within 10 weeks of your holiday start date the full amount of rental and security deposit must be included with the booking form. The person signing the form will be responsible for all payments due in respect of the booking.

SECURITY DEPOSIT

A returnable security deposit of £200 /$350 is required which must be paid with the balance of the rental. This is to cover any damage, breakage and loss to the property or contents, excessive cleaning costs and for lost keys which necessitates changing locks. All guests must treat the property and it’s contents with respect. Should any damage or breakages occur they should be immediately reported to our local representative, who will arrange for the necessary repairs, replacements etc. Following an inspection of the villa by our agent, the full £200 /$350, or such lesser sum should any of the above apply, will be refunded after you return home. This will normally be no later than 30 days of vacation of the premises.

In the event of any damage/loss which is assessed to be in excess of the security deposit, the client will be held responsible for full re-imbursement of the outstanding amount within 14 days. It is important that the property is left clean and tidy at the end of the rental period.

BALANCE PAYMENT

The balance of payment plus security deposit must be paid at least 10 weeks prior to the commencement of the holiday rental period. Failure to pay the balance due 10 weeks before departure will entitle us to cancel your booking and re-advertise the villa for that period.   The relevant cancellation charges will apply.

CHANGES OR CANCELLATION BY OWNERS

In the unlikely event that circumstances beyond our control necessitate cancellation of the booking we will only be liable to refund monies already paid by the party leader.

CANCELLATION BY CLIENT

Any cancellation by the client must be confirmed in writing by the party leader. In the event of cancellation the following charges will apply:

More than 10 weeks prior to departure Deposit only

Between 10-8 weeks prior to departure 25% of the rental costs
Between 8-6 weeks prior to departure 50% of the rental costs
Between 6-4 weeks of departure 75% of the rental costs
Less than 4 weeks prior to departure 100% of the rental costs

ARRIVALS AND DEPARTURES


The rental period begins at 4.00 pm. (local time) on the day of arrival and terminates at 10.00 am. (local time) on the day of departure. Vacating after 10.00 am. may incur charges equivalent to one day’s accommodation cost.

INSURANCE

When signing the booking form, please ensure that you are adequately covered by insurance. It is a condition of booking that you and all members of your party have full insurance cover which offers maximum protection against cancellation, medical expenses, travel etc.

FORCE MAJEURE

The owners or owners’ agent can not accept responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond their control, including, but not restricted to war, terrorist activity, civil commotion, technical problems with transportation, flight delays or cancellations, airport closures, adverse weather conditions, fire, flood, industrial dispute or failure of public supplies.

LIMITATION ON LIABILITY

The owners or owners’ agent do not accept any liability whatsoever for death, personal injury, sickness, accident, delay or loss of luggage or personal effects or any other loss or misadventure which may occur whilst renting the property. It is the responsibility of an adult member of the party to ensure that children are properly supervised at all times within the villa, the pool and surrounding area. No diving or horseplay in the pool. Glass is not permitted in the pool deck area. Use of the pool, the community pool, tennis courts and recreation area is entirely at your own risk. Please bear in mind that the villa is situated on a development which consists of both residential and vacation homes. Therefore, the owners or owners’ cannot be held responsible for any ongoing construction, alterations to existing houses or any noise as a result thereof on or around the housing development. This waiver is also applicable to people visiting the property as guests of the client.

COMPLAINTS

Should a problem arise with villa during your stay please contact our local representative, who will do his best to assist and rectify the matter as soon as is practically possible. In the unlikely event of a problem not being resolved you are asked to notify us within 7 days of your return. No action can be taken nor liability accepted for any complaints received after this period.

DESCRIPTIONS

All descriptions given in the document are made in good faith, but no liability can be accepted for errors or omissions.

BEHAVIOUR

We expect all our clients to behave reasonably and have due consideration for other people. In the event of a client behaving in such a way as to cause or be likely to cause, in the opinion of our representative, danger, distress, annoyance to any third party or damage to the property, we reserve the right to terminate your rental. In this situation our responsibility for your holiday arrangements will immediately cease and we will not be responsible for meeting any costs or expenses you may incur as a result, paying any compensation or making any refunds. Clients should treat the property with respect and leave the home in a clean condition. Nothing should be allowed to interfere with the peace and comfort of other residents and guests.

LAW

Signing of the booking form constitutes acceptance of a contract on these terms. The contract made is governed by, and shall be interpreted in accordance with, English Law and the parties hereto shall both submit to the jurisdiction of the English Courts.
